From 1st December 2017 the Assured and Short Assured Tenancy will be replaced by the new Private Residential Tenancy, in line with the Private Housing (Tenancies)(Scotland)Act 2016.
Any new tenancies created after 1st December 2017 will be subject to the new Private Residential Tenancy. Any existing assured and short assured tenancies will continue until brought to an end.
The new tenancy will improve housing security for tenants and provide safeguards for landlords. Tenants will no longer be tied in to a minimum stay of 6 months. The tenancy will now last until the tenant wishes to leave giving 28 days’ notice or if the landlord uses one or more of 18 grounds for eviction.
We have confirmed with ARLA that all existing short assured tenancies will remain where they continue under tacit relocation or a rolling lease and we are working with them to keep you compliant.
